Is THCA Legal in Texas? 2026 Guide
Yes — hemp-derived THCA (tetrahydrocannabinolic acid) is legal in Texas as of April 2026 under House Bill 1325, the state’s hemp law. Texas defines hemp by delta-9 THC content (≤0.3% by dry weight), not total THC, so high-THCA flower that tests compliant for delta-9 is not classified as marijuana under state law.
The short answer
THCA is legal in Texas under HB 1325, the 2019 state law that aligned Texas with the federal 2018 Farm Bill. Hemp is defined as cannabis with no more than 0.3% delta-9 THC on a dry-weight basis. Because Texas measures delta-9 rather than total THC, raw THCA flower — which converts to delta-9 only when heated — is treated as legal hemp at retail. The caveat: state lawmakers tried to ban consumable hemp products in 2025 (Senate Bill 3), and a similar push is expected in the 2026 session. Lt. Governor Dan Patrick has made this a top priority. What HB 1325 actually says
HB 1325 was signed into law by Governor Greg Abbott on June 10, 2019. It amended Texas Health and Safety Code Chapter 443 to define hemp the same way Congress did the year before:
“Hemp” means the plant Cannabis sativa L. and any part of that plant, including the seeds of the plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.
In plain English: anything from a hemp plant — including flower, vapes, pre-rolls, gummies, diamonds, and concentrates — is legal as long as the plant tested at or below 0.3% delta-9. The statute lists “acids” explicitly, which is the relevant word for THCA. THCA itself is a cannabinoid acid, not delta-9, and it does not count against the 0.3% limit at the testing stage Texas uses.
This is the gap that has built the entire Texas hemp economy. A typical THCA flower bud might test at 25% THCA and 0.2% delta-9 — perfectly legal under HB 1325, even though smoking it produces a delta-9 effect indistinguishable from regulated marijuana. Texas has not closed that gap, and as of April 2026 the state still tests against delta-9 alone.
Total THC vs delta-9 — why this matters
Some states (Colorado, Oregon, California for cannabis-channel goods) use a total-THC formula:
total THC = delta-9 THC + (THCA × 0.877)
The 0.877 multiplier reflects the mass lost when THCA decarboxylates (heats) into delta-9. Under that math, a 25% THCA bud tests at roughly 22% total THC — far above the 0.3% hemp limit. That math is what defines the difference between “legal in Texas” and “felony in Idaho.”
Texas does not use the total-THC formula at retail. The Texas Department of State Health Services (DSHS) and the Texas Department of Agriculture both certify hemp using delta-9 only at the post-decarb / post-harvest test, in line with the USDA’s interim final rule pre-2021. - 2024 DSHS rule attempt — The Department of State Health Services tried to administratively ban delta-8 by rule. A Travis County district court issued an injunction; the rule was held unenforceable.
- 2025 SB 3 — The state Senate passed SB 3, which would have banned all consumable hemp products with any THC, including THCA flower. It cleared the Senate 26-5 in March 2025. The House softened the bill but Lt. Governor Patrick demanded a full ban. Governor Abbott vetoed SB 3 in June 2025, citing concerns the broad ban was unenforceable and would push consumers to illicit markets. Patrick called for a special session; one is expected.
- 2026-03-15 — Hemp industry trade group hosts compliance workshop in Texas — operators briefed on testing and labeling expectations under any future regulatory rewrite.
- 2026-02-08 — Texas Department of Agriculture publishes 2026 hemp licensing renewal guidance.
- 2025-11-21 — Texas legislature reviewed but did not advance THCA restriction proposal during interim committee hearings.
The takeaway: every legislative session since 2019 has produced a serious attempt to restrict consumable hemp, and every attempt so far has either failed, been vetoed, or been blocked in court. That pattern may not hold forever.

Three forces are pulling on Texas hemp policy at once:
1. The 2025 special session. Governor Abbott has signaled openness to “reasonable regulation” — likely a 21+ age gate, lab-testing rules, packaging restrictions, and possibly a serving-size cap on edibles. This is more probable than a full ban.
2. The 2026 federal Farm Bill. Congress is overdue on a Farm Bill rewrite. The current draft text (Mary Miller Amendment in House Agriculture Committee) would close the THCA loophole nationally by switching hemp’s definition to total THC. 3. Litigation. The Texas Hemp Coalition and individual operators have filed multiple suits since 2024 challenging both rule-making and statutory attempts to restrict the category. Expect another round in 2026.

There is no penalty for legal hemp-derived THCA possession. Marijuana possession (defined separately as cannabis above 0.3% delta-9) remains a Class B misdemeanor for two ounces or less. Police in Texas have struggled to distinguish legal hemp from illegal marijuana in the field — most counties have stopped prosecuting low-level possession at all. Is delta-8 also legal in Texas?
