Is THCA Legal in Washington? 2026 Guide
THCA (tetrahydrocannabinolic acid) is restricted in Washington as of April 2026. SB 5367 (2023) imposed strict limits on intoxicating hemp cannabinoids and effectively channels any psychoactive cannabis product into the licensed I-502 retail system, not the hemp market.
The short answer
Washington has had legal adult-use cannabis since Initiative 502 passed in 2012, with retail sales through licensed dispensaries regulated by the Liquor and Cannabis Board (LCB). SB 5367 (2023) closed the hemp-derived intoxicating cannabinoid loophole by requiring that any consumable hemp product with detectable amounts of THC above defined limits be sold only through I-502 licensed retailers. The bill applies to delta-8, delta-10, HHC, THCP, and THCA.
For consumers, the practical answer: if you want a psychoactive cannabis product in Washington, the legal path is a licensed I-502 dispensary, not a hemp shop. Hemp-derived THCA products designed for the rest of the country’s hemp channel are largely non-compliant in Washington’s intoxicating-hemp framework. Many out-of-state hemp brands have geofenced Washington for high-THCA SKUs.
What SB 5367 actually says
SB 5367 amended RCW 69.50 to define and restrict “synthetic” and “non-naturally-occurring” cannabinoids and to set thresholds for total THC content in consumable hemp products. The key provisions:
1. Total-THC standard. Hemp products at retail must conform to the federal 0.3% total-THC limit, applied as delta-9 + 0.877 × THCA.
2. Channel restriction. Any consumable cannabis product above defined intoxicating thresholds must be sold through an I-502 licensed cannabis retailer — not through hemp shops, gas stations, or general retail.
3. LCB authority. The Liquor and Cannabis Board sets and enforces the rules; the Department of Agriculture continues to license hemp cultivation but cannot sell intoxicating products outside the I-502 channel.

Can you legally buy THCA in Washington?
Through an I-502 dispensary: yes. Licensed cannabis retailers carry full-spectrum cannabis flower, vapes, edibles, and concentrates that include THCA in their natural cannabinoid profile. These are sold as cannabis products, not hemp products.

How Washington compares to neighbors

What could change in 2026-2027
Two questions:

2. LCB rule refinements. Washington’s rule-making is active — minor compliance changes are likely each year. The structural framework (channel restriction + total-THC) is unlikely to loosen in the near term.
